Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Withdrawal period: the period during which the consumer may exercise the right of withdrawal;

Consumer: the natural person who is not acting for purposes relating to a trade, business, craft, or profession and who enters into a distance contract with the merchant;

Day: calendar day;

Continuous performance contract: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;

Durable medium: any means that enables the consumer or the merchant to store information addressed personally to them in a way that allows future consultation and unchanged reproduction;

Right of withdrawal: the consumer’s option to withdraw from the distance contract within the withdrawal period;

Merchant: the natural or legal person who offers products and/or services to consumers at a distance;

Distance contract: a contract concluded within the framework of an organized system for distance selling of products and/or services, where exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract;

Means of distance communication: any means that can be used to conclude a contract without the consumer and merchant being physically present in the same place at the same time;

Terms and Conditions: these Terms and Conditions of the merchant.

Article 3 – Scope of Application

These Terms and Conditions apply to every offer made by the merchant and to every distance contract concluded between the merchant and the consumer. Before the distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated prior to the conclusion of the contract that the Terms and Conditions can be consulted and will be sent free of charge upon request. If the contract is concluded electronically, the Terms and Conditions may be provided electronically in a way that allows storage on a durable medium. If specific product or service conditions apply in addition to these Terms and Conditions, the consumer may rely on the provision most favorable to them. If one or more provisions are invalid, the remaining provisions remain in force and the invalid provision will be replaced by one that most closely reflects the original intent.


Article 4 – The Offer

If an offer is subject to limited validity or conditions, this will be expressly stated. All offers are non-binding and may be modified or withdrawn. Offers include a complete and accurate description of the products and/or services. Images are representative but may differ slightly from the actual product. Obvious errors do not bind the merchant. Prices are exclusive of import duties and taxes, which are the responsibility of the customer. Each offer clearly states pricing, shipping costs, contract formation, payment and delivery terms, withdrawal rights, contract language, duration, and available variations.


Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and meets the stated conditions. Electronic acceptance is confirmed electronically. Until confirmation is received, the consumer may cancel. Secure systems are used for data transfer and payments. The merchant may assess payment capacity and refuse or condition orders if justified. Required information will be provided at or before delivery. All contracts are subject to product availability.


Article 6 – Right of Withdrawal

The consumer has 14 days after receipt to withdraw from the contract without providing a reason. Products must be handled carefully and returned in original condition. The consumer must notify the merchant within 14 days and return the product within an additional 14 days, providing proof of shipment. Failure to comply makes the sale final.


Article 7 – Costs in Case of Withdrawal

Return shipping costs are the responsibility of the consumer. Refunds are processed within 14 days after notification, provided the product or proof of return is received.


Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for custom-made or personalized products, perishable goods, hygiene products once opened, sealed media once unsealed, products subject to market fluctuations, and certain services provided on specific dates or already started with consent.


Article 9 – Price

Prices will not increase during the stated validity period except due to legal changes. Delivery occurs outside the European Union and import charges may apply upon delivery. Prices are subject to typographical errors.


Article 10 – Conformity and Warranty

Products comply with the contract and applicable standards. Manufacturer warranties do not affect statutory rights. Defects must be reported within 14 days. Warranty excludes misuse, unauthorized modifications, or abnormal conditions.


Article 11 – Delivery and Performance

Orders are handled with care and delivered to the address provided. Delivery occurs within a reasonable time and no later than 30 days unless otherwise agreed. In case of delay or non-performance, the consumer may cancel and receive a refund. Risk transfers upon delivery.


Article 12 – Continuous Performance Contracts

Indefinite contracts may be terminated at any time with one month’s notice. Fixed-term contracts are not automatically renewed unless stated.


Article 13 – Payment

Payments must be made within 7 business days unless otherwise agreed. Errors in payment details must be reported immediately. Reasonable costs may be charged in case of non-payment.


Article 14 – Complaints Procedure

Complaints must be submitted within 7 days of discovery and are handled within 14 days. Valid complaints may result in repair or replacement.


Article 15 – Disputes

All agreements are governed by Dutch law, regardless of the consumer’s place of residence.


Article 16 – CESOP

Payment service providers may be required to report transaction data under EU CESOP regulations.
